'Open Carry' Law Student Puts Cop In His Place (WATCH)

Detained for open carry.

"I was detained by Portland PD officer J McDonald on 26MAY2012.  He detains me without suspicion of any criminal activity in violation of Delaware v Prouse.  He admits his sole reason for stopping me is my legally carried firearm in violation of US v DeBerry.  He seizes my weapon with no reasonable suspicion that I've committed a crime in violation of Terry v Ohio.  He demands my ID without reasonable suspicion in violation of Hiibel v Nevada"

Great job by this man! I'm not sure I would do this if it wasn't such a public area, though. If you are alone someplace and cops stop you, then maybe you are better complying? You could end up with a bullet in the head otherwise. Not worth it. But out in public this can work well.

Another emasculated open carry activist bending over and spreading his cheeks for the "man." Take a few friends, hopefully with some combat experience and set up so that when some rights violating simpleton comes sniffing around, you can say..."I'm not surrendering my weapon to you, officer...if you proceed to attempt to molest me, you will be fired upon."

If cop makes a move for his gun, take him out.

A couple of encounters like that and nationally, cops will stop molesting open carry activists.

These types of contacts, where the "man" takes the weapon away from submissive Americans is exactly NOT what the movement needs to succeed.

Do this right, or stay the hell home.

This was consummate FAIL.

Had there been a crazy nutcase with a gun shooting people in that area, this guy could have saved the day by shooting that person down, potentially saving the life of whomever called the police for simply carrying a weapon of self defense. The public citizen needs access to a tutorial or course about basic law in self-defense of Constitutional rights. The officer only backed down when the law student cited case law.

El Chrome-dome pig needs to spend about five years in the Graybar hotel for civil rights violation under the color of law. I hope you all know that police departments go out of their way to hire low IQ people and the courts have ruled that is okay. The various pig departments realize that intelligent employees will questions illegal orders while those on the left side of the IQ bell curve are stupid automatons who will do as they are instructed.

What an inspiring display of clarity, purpose and fortitude. I think the cop realized he was over matched and out of his league. Imagine if he would have "accidently" pulled the trigger on your gun!?! What was so amazing was your ability to refrain from sticking your foot in your mouth, like most dumbed down Americans, and "popping" off, which is what that prowling officer was attempting to get you to do. Whereas, if seemed from my vantage point you were cool as a cucumber (but who knows what kind of chatter" was going on inside between your ears) by your "suspenders" remark, and, with out a doubt, you "owned" the knowledge, inside and out.

I applaud this persons actions and remaining calm with the officer thereby giving no reason whatsoever to escalate the interaction. However I must agree with Brent, under no circumstances surrender your sidearm and maintain a tactical awareness of the positioning of people involved plus any bystanders and calmly but clearly state your intentions to defend yourself should you be molested, manhandled or otherwise interfered with. People have to let the police (who do have a shit job) know that legally going about your business is just that, and that interference with that has consequences, not all of them positive. Anyway, well done and keep your back straight, your head held up and your aim true.

@C.Okeefe If you were alone someplace alone with the LEO your chances of being shot dead by the jackbootdd moron just went up 100 fold. You are better off to shoot first and ask questions later than to comply. You would also have a better chance of escape without detection. Do not hand over your weapon under any circumstances. The second amendment is not a joke, it is not someting that you should give up ever. If everyone started enforcing the law against unlawful LEOs we wouldn;t be in the situation that we are today.

No cop cares if innocent bystanders are down range of their fire. All they care about is having a chance to use their service weapons, kill people, and not be charged for doing so. It doesn't come up often, so when it does, they are eager. Thinking about innocents is the last thing on their mind. They deliberately hire low-average to average IQ people for the job, because these are not people who are deep-thinkers to begin with. They just want thugs who will respond to orders, just like any solider in any military. Maybe it wasn't this way 30 years ago, but today you can clearly see that they are dressing cops as soldiers, making them look intimidating, trying to make them look muscular...and they arm them to teeth. When soldiers in Afghanistan or Iraq are able to consider anyone a terrorist and just shoot them dead, and there are no repercussions, cops at home see the same thing and get the same message. No matter what they do, they will always be exonerated. District Attorney's will only charge a cop if it turns into a viral You Tubetube video and even then, the cop likely gets off easy. Such messages reinforce the idea that a cop can murder and walk away almost certain they will not be charged. For something simple like taking a man's legally owned, legally carried firearm away for a few minutes and illegally detaining that person... we all know there is zero chance the cop even gets questioned by a superior...case in point, his superior showed up and didn't apologize and say, sorry citizen, this poorly trained officer should never have stopped you without probably cause and he should have known this wasn't probably cause....we are terribly sorry and I will deal with this situation personally. NEVER HAPPEN! When you know you can get away with murder, you will try.

The process is the punishment. A small victory (very small) that they guy got his gun back. Private citizens lawfully carrying should not be hassled by the gangsters w badges. Getting stopped, getting shaken down, having to go thru the time and expense of going thru the system to get your piece back. THAT IS THE PUNISHMENT> THAT IS THE DISINCENTIVE TO CARRY.

Until LEO's are civily (and possibly criminally) liable for these shakedowns, they will continue.

Omg what an annoying little shit disturber. I hope someone beats the hell out of him. Police officers are here to keep us safe. He wasn't rude or power tripping or anything. If I saw buddy walking down the street with a gun I'd call the cops too. How do I know he's not some maniac about to go on a rampage??? How does it hurt to try and find out? Wow he wasn't breaking any laws, good for him...he was still acting like an ass. Too bad there's no laws against that. Probably sued the police department too. Way to waste the tax payers money. I understand why the cop stopped you. But he should have been a little nicer about it. "Hay man, people are freeing out over your open carry. Just want to make sure everything its ok." I understand her took the gun for his own safety. More people need to carry so people don't freek over a gun! Not everyone with a gun is out to kill someone like the media portrays us!

Ok officer takes firearm for safety. Eh ok some states it is legal to carry as long as a round is not chambered. Not sure if Maine is one of them. Asks for ID and gets told no. Now I suspect you have something to hide and yes now I suspect you are a felon. No I dont care about what court case has done what to who or where. Im a police officer not a lawyer. Interpretation of law is their job an officers job is to protect the peace. An ID check takes 30 seconds ok your clean heres your gun and have a good day. Nor would I apologize for stopping him. Doing my duty leaves me nothing to apologize for. But now because of this video alot of felons can pull this and some of them will get away with and more then likely a few crimes will happen because of it. Good job on making a statement.

No im not a liberal or the other side. Im an American. I faught for my country and for the downtrodden where ever i was shipped to. Yes i carry with a concealed permit. If asked i produce ID as i have nothing to hide. Laws and those that go out of their way to make a statement or money from them is the concern here.
