"I was detained by Portland PD officer J McDonald on 26MAY2012.  He detains me without suspicion of any criminal activity in violation of Delaware v Prouse.  He admits his sole reason for stopping me is my legally carried firearm in violation of US v DeBerry.  He seizes my weapon with no reasonable suspicion that I've committed a crime in violation of Terry v Ohio.  He demands my ID without reasonable suspicion in violation of Hiibel v Nevada"

What an inspiring display of clarity, purpose and fortitude. I think the cop realized he was over matched and out of his league. Imagine if he would have "accidently" pulled the trigger on your gun!?! What was so amazing was your ability to refrain from sticking your foot in your mouth, like most dumbed down Americans, and "popping" off, which is what that prowling officer was attempting to get you to do. Whereas, if seemed from my vantage point you were cool as a cucumber (but who knows what kind of chatter" was going on inside between your ears) by your "suspenders" remark, and, with out a doubt, you "owned" the knowledge, inside and out.

I applaud this persons actions and remaining calm with the officer thereby giving no reason whatsoever to escalate the interaction. However I must agree with Brent, under no circumstances surrender your sidearm and maintain a tactical awareness of the positioning of people involved plus any bystanders and calmly but clearly state your intentions to defend yourself should you be molested, manhandled or otherwise interfered with. People have to let the police (who do have a shit job) know that legally going about your business is just that, and that interference with that has consequences, not all of them positive. Anyway, well done and keep your back straight, your head held up and your aim true.

No cop cares if innocent bystanders are down range of their fire. All they care about is having a chance to use their service weapons, kill people, and not be charged for doing so. It doesn't come up often, so when it does, they are eager. Thinking about innocents is the last thing on their mind. They deliberately hire low-average to average IQ people for the job, because these are not people who are deep-thinkers to begin with. They just want thugs who will respond to orders, just like any solider in any military. Maybe it wasn't this way 30 years ago, but today you can clearly see that they are dressing cops as soldiers, making them look intimidating, trying to make them look muscular...and they arm them to teeth. When soldiers in Afghanistan or Iraq are able to consider anyone a terrorist and just shoot them dead, and there are no repercussions, cops at home see the same thing and get the same message. No matter what they do, they will always be exonerated. District Attorney's will only charge a cop if it turns into a viral You Tubetube video and even then, the cop likely gets off easy. Such messages reinforce the idea that a cop can murder and walk away almost certain they will not be charged. For something simple like taking a man's legally owned, legally carried firearm away for a few minutes and illegally detaining that person... we all know there is zero chance the cop even gets questioned by a superior...case in point, his superior showed up and didn't apologize and say, sorry citizen, this poorly trained officer should never have stopped you without probably cause and he should have known this wasn't probably cause....we are terribly sorry and I will deal with this situation personally. NEVER HAPPEN! When you know you can get away with murder, you will try.

The process is the punishment. A small victory (very small) that they guy got his gun back. Private citizens lawfully carrying should not be hassled by the gangsters w badges. Ok officer takes firearm for safety. Eh ok some states it is legal to carry as long as a round is not chambered. Not sure if Maine is one of them. Asks for ID and gets told no. Now I suspect you have something to hide and yes now I suspect you are a felon. No I dont care about what court case has done what to who or where. Im a police officer not a lawyer.
