Quotes...

  • "And you're going to find that they can't find the paper up there on Wall Street."
  • "Don't leave your home...because you know what, when those companies say they have your mortgage, unless they have a lawyer who can put his finger on that mortgage, they don't have that mortgage!"
  • "So I say to the American people - you be squatters in your own homes!  Don't you leave!"

A coalition of as many as 40 state attorneys general is expected Wednesday to announce an investigation into the mortgage-servicing industry, an effort some of them hope will pressure financial institutions to rewrite large numbers of troubled loans.

The move comes amid recent allegations that mortgage-servicers, which include units of major banks such as Bank of America Corp., submitted fraudulent documents in thousands of foreclosure proceedings nationwide.

Barring surprising improvements in the economy, most U.S. Federal Reserve officials believed new steps would be needed to jump-start growth when they last met Sept. 21.

Fed officials' discussions focused on buying more U.S. Treasurys or new strategies for inflation if prices remained too low and unemployment too high, minutes of their last meeting, released with the usual lag on Tuesday, showed.

"Meeting participants discussed several possible approaches to providing additional accommodation but focused primarily on further purchases of longer-term Treasury securities and on possible steps to affect inflation expectations," the minutes showed.

DB--

Maybe Rep. Kaptur had talked to Judge Boyko about his bankster bitch slap heard round the world:

http://commercialforeclosureblog.typepad.com/indiana_commercial_forecl/files/BoykoOpinion.pdf

Boyko points out that for a foreclosing party to even have standing to sue, it must prove that it has both the mortgage/deed AND the promissory note of the borrower.

My understanding is that these two legal instruments got separated in the securitization process and ended up in the hands of two different parties. If that is the case, no party can have standing to foreclose (unless the note holder and the deed holder can pretend to be a single party under some goofy agency theory).

If so, not only are thousands of homeowners immune as a matter of law from foreclosure, there are legions of mortgage-backed security purchasers sitting on massive damages claims from the big banks. You'd know better than I how huge the claims are, but I'm pretty sure they're big enough to wipe out every last one of them.

Request for Congressional Foreclosure Panel to Examine Foreclosure Lawyers
http://www.change.org/petitions/view/request_for_congressional_foreclosure_panel_to_examine_foreclosure_lawyers#

"Although increasing numbers of courts are continuing to reject improper and fraudulent foreclosures, the Congressional Foreclosure Panel examination of mortgage services and foreclosure practices did not include foreclosure lawyers.

Lawyers are officers of the court; knowledge of applicable laws and civil procedure is not required from mortgage lenders. In states that require judicial foreclosures, lawyers are the ones who file lawsuits to seize and sell property; and lawyers are responsible for filing and recording foreclosure property deeds.

An investigation could prove helpful to sorting out whether improper and illegal foreclosure proceedings are linked to any self-dealing conduct disadvantaging lenders, investors, homeowners, and city governments. . .”

He sure dose AB. Great piece, and has it goin on too............? If every American Person would read this, maby then they would know and understand just what the goverment did to the people. And it was all planed out some 40 years ago.

Just think how many have been kicked out of thAre homes and neaver should of been. Thoes that get behind on their payments and lost the home, "Ohhhhhh - Weeeeeell" like we say here in the Ozarks ! Most knew better.

But, the ones that lost one income, and did nothing wrong, my hart gos out to them. Thats how the goverment planed it.

Michael Moore has a great interview with Kaptur in Capitalism: A Love Story about the TARP bailout. She explains what happened between the House's rejection of TARP and its passage 4 days later. That interview alone is worth the price of the rental. Her candor is astonishing.

While I disagree with many of Moore's sweeping assertions (e.g., capitalism, bad), his content is just dynamite.

To DB. I an personally aware of a major bank who is custodian for millions of mortgage documents. Their procedure was to separate the documents upon receipt, and file the rest both physically and in their database.
