Steal Billions Like Dimon Blankfein And You're Doing God's Work, Sell $31 Of Pot And Go To Jail For 10 Years
An Oklahoma woman has been sentenced to 10 years in prison for selling $31 of marijuana.
Patricia Marilyn Spottedcrow, a 25-year-old mother of four, and her mother, Delita Starr, 50, sold an $11 dime bag to a police informant in Oklahoma on Dec. 31, 2009. The informant returned two weeks later to buy $20 of marijuana. Spottedcrow, who worked in nursing homes before her arrest, told The Oklahoman she did it to get some extra money.
The women were charged with drug distribution and possession of a dangerous substance in the presence of a minor, because Spottedcrow's children were in the house during the transaction. They were offered plea deals of two years in prison but decided to enter a guilty plea instead, a gamble they took because neither had prior convictions and because the amount of drugs sold was so small.
The gamble did not pay off. Spottedcrow was given sentences of 10 years in prison for distribution and two years for possession, to run concurrently. When she was picked up to be taken to prison, she had marijuana in her jacket pocket, which led to another two-year concurrent sentence and a fine of nearly $1,300.

Neither the AOL piece or the original Oklahoman source say whether Spottedcrow was convicted by a jury (some defendants waive their 7th amendment rights). If so, what is wrong with those people?

Noel--completely agree. What a waste of money pursuing "crimes" like these. Not to mention the fact that Patricia Spottedcrow's daughter will grow up without her mom for most of her childhood. What's the price tag on that? More than 3 dime bags, I guarantee you.
The fact is, though, that pot is damn close to being de facto (but not de jure) legal anyhow. In California, possession fines are low, with no jail. And with the passage of medical marijuana laws that allow "patients" some rather generous allotments, there is a lot of high-grade available in states like California, Oregon, and Michigan.
It strikes me as ridiculous for near-bankrupt states to pursue cases like Spottedcrow's when they could be generating revenue by legalizing and taxing the stuff.

Not that I'm advocating the use of it I don't think kids should use drugs!
But I think adults should be free to do as they please and I think people should be careful about wanting to take away rights even those of smokers that is a slippery slope and could lead to the loss of other rights.

Other way around. Spottedcrow rejected a plea bargain deal and gambled on a trial. That gamble failed as the plea deal was for way less time than 10 years. But nothing in the source pieces indicates whether it was a bench trial or a jury trial.

Comment: I know a bit about this from having served from the Fire side of things..... If you can get the patient on an ambulance for even for 5 seconds the hospital or ambulance service gets about $5,000.00 immediately. For a life flight it was 15K and that was back in 2002. Outside of that the FD got nothing......

but "fair" is "fair." Our prisons are crammed full of these "lesser" type (less dangerous) type criminals and something has to be done to keep this type of incarceration from happening. Having the lady "do her time" on week-ends, or some similar arrangement seems to be a better approach.....I would not be in favor of her not getting some type of punishment, for selling drugs is very serious business......but again I say, "fair" is "fair" and the judge in this case seemed to enjoy "putting this lady away" when I think if she had offered the lady some advice and counsel.....maybe she could have learned her lesson, and still been able to take care of her children.
