OUTRAGE: Morgan Stanley banker escapes felony charges for hit and run 'because it could jeopardize his job'

Since this story broke yesterday, all hell has broken loose in the righteous blogoshpere.  Phone number for the DA's office is included, should be inclined to call.  You aren't going to believe the details.

A Morgan Stanley wealth manager will not face felony charges for a hit-and-run because Colorado prosecutors don't want him to lose his job.

Martin Joel Erzinger, who manages more than $1 billion in assets for Morgan Stanley in Denver, is being accused only of a misdemeanor for allegedly driving his Mercedes into a cyclist and then fleeing the scene, Colorado's Vail Daily reports. The victim, Dr. Steven Milo, whom Erzinger allegedly hit in July, suffered spinal cord injuries, bleeding from his brain and, according to his lawyer Harold Haddon, "lifetime pain."

But District Attorney Mark Hurlbert says it wouldn't be wise to prosecute Erzinger -- doing so might hurt his source of income.

"Felony convictions have some pretty serious job implications for someone in Mr. Erzinger's profession, and that entered into it," Hurlbert said. "When you're talking about restitution, you don't want to take away his ability to pay."

"We have talked with Mr. Haddon and we had their objections, but ultimately it's our call," Hurlbert said.

Here's what happened, according to the Vail Daily:

Milo was bicycling eastbound on Highway 6 just east of Miller Ranch Road, when Erzinger allegedly hit him with the black 2010 Mercedes Benz sedan he was driving. Erzinger fled the scene and was arrested later, police say.

Erzinger allegedly veered onto the side of the road and hit Milo from behind. Milo was thrown to the pavement, while Erzinger struck a culvert and kept driving, according to court documents.

Erzinger drove all the way through Avon, the town's roundabouts, under I-70 and stopped in the Pizza Hut parking lot where he called the Mercedes auto assistance service to report damage to his vehicle, and asked that his car be towed, records show. He did not ask for law enforcement assistance, according to court records.

Erzinger told police he was unaware he had hit Milo, court documents say.

Details of the injuries from the Daily Mail:

Over the past six weeks he has suffered 'disabling' spinal headaches and faces multiple surgeries for a herniated disc and plastic surgery to fix the scars he suffered in the accident.

He suffered spinal cord injuries, bleeding from his brain and damage to his knee and scapula, according to court documents.

'He will have lifetime pain,' his lawyer Harold Haddon told the court.

'His ability to deal with the physical challenges of his profession - liver transplant surgery - has been seriously jeopardised.' 

'Mr Erzinger struck me, fled and left me for dead on the highway,' he wrote. 'Neither his financial prominence nor my financial situation should be factors in your prosecution of this case.'

This story is interesting in its location of the border between the feudal overlords and the serfs. Normally MSM plays up the fact that the person getting fucked over is a deadbeat homeowner or has been out of work for years. But a doctor? However will they spin that one?

The politicians got to keep Mr. Erzinger stealing and making political donations to maintain the lifestyles our politicians enjoy. The little guy never has a voice, even if it is a doctor who dedicates his life to saving others. Mr Erzinger made a cowards decision in choosing to leave a man to potentially die by his actions, and based on his actions when he called for a tow, he apparently see's no difference between hitting a bird or a human being.

Yeah, Morgan Stanley would never have a clue that Hit-and-Run Erzinger has a problem with integrity unless a jury tells them Erzinger is a felon . That explains alot.

That's a bizarre inversion. The victim wants a prosecution but the prosecutor is settling for a garnished payroll check. Do uninsured hit-and-runners get the same consideration in Vail?

I'm thinking Hurlbert may not have much more of a career as a prosecutor because, well, people sometimes don't understand these things the way they ought to be understood. But a creative and compassionate legal mind like Hurlbert's might find more rewards with a cushy job in the financial industry, anyway.

The financial manager might not have known he hit the cyclist. I was told I hit a cyclist, knocking him off his bicycle and damaging the bike, and I never saw, felt, or heard a thing so I know it's possible. I found out when the cyclist ran up to my car window while I was stopped for traffic. I looked for vehicle damage and found none -- until a couple weeks later when I was washing it, and it was a single spot confined to a couple inches under the front bumper. Why would you charge someone with a felony for what might have just been an accident? Maybe it wasn't even his fault. Maybe the cyclist veered into the traffic lane. The article didn't say there were any witnesses. It's his insurance that would be paying anyway, so I don't see using the potential loss of source of income as having any relevance. On the other hand, maybe he did know and thought if he kept driving, nobody would be able to identify him. Either way, he certainly didn't hit the cyclist intentionally and with no way of proving he knowingly left the scene of an accident, he's not a criminal and shouldn’t be charged with anything at all. His insurance should be responsible for any financial liability, which is why the law requires we carry insurance.

Reading a previous post I remembered an accident I had.
The other driver turned into my left front wheel hard enough to crush the "a" frame into the engine block. After he walked around my car he told the police "I didn't really hurt his car. Just look at the dent in the right side door."
I guess some people would have a hard time NOT agreeing with his line of thinking.
I always thought we were supossed to be responsible for our actions. It does not matter if it is an accident or an "on purpose" we are still responsible.

Put Hurlbert (what a name. Sounds more like a suggestion!) on bike, tell him to start pedaling, then run him over with Erzinger's Mercedes and leave him to die. THEN ask him how he would handle this case.

If that a**hole was driving a 2010 Mercedes Benz and worked where they say, he probably has full coverage to the limit on his auto insurance. I think that the only restitution that D.A. Hurlbert is worried about has nothing to do with Dr. Milo.

Mr. Erzinger committed a felony and should be prosecuted to the full extent of the law. If one of my working class friends were in his situation he would be facing a class 5 felony punishable by 1 to 3 years in prison and as much as $500,000 in fines and you can bet D.A. Hurlbert would be seeking the maximum penalty in court.

Really? He was driving a 2010 Benz (probably the flagship S-class). I wonder what the bankster's explanation was for how the following happened...

I know this will ignite an entirely separate firestorm in itself but I can help but wonder, is the guy that is charged with the hit and run a rich Jew? Racist or not, fact or fiction, millions of people think that this is why so many hundreds alleged crooked bankers are not already charged with financial crimes over the past few years is that they are insulated and are above the law.

He works for Morgan Stanley-and that's why. They're the bank to the rich, and the rich don't need their nannies in jail. Whatever would they do without their money babysitters?

The rest of us can go to hell. That's essentially what the D.A is doing. One law for the rich/connected and another set for the rest of us. You can buy your way out of anything if you've got enough money and friends. This guy works for a politically-connected powerhouse of a bank. Ain't ever gonna see the inside of a jail cell.

As for his victim, the best way to get this guy to suffer is to sue him penniless. That's the only way his pain and suffering will ever get better. Obviously the justice system isn't interested.

Inatentave Driving, kill many good people everyday. There was no say about the bike rider swerved into the road way. So the car driver vered into the "Right-a-Way" of the bike rider. The bike had the right-of-way, to the right of the white line.

Wait a second. Are you saying that you ate the deer you hit after grilling it, Texas Dar? If so, that's fucking awesome--and something I'd really like to try. Do you have any pointers or special marinades? Any details would be greatly appreciated. I don't know what a PCB grill is. I use a Weber 22 1/2" Charcoal Silver model. Would that work?

Here is a good venison marinade Cheyenne,

1/3 c. wine vinegar
3 tbsp. salad oil
1 tbsp. minced onion or 1/4 c. chopped onion
1/8 tsp. garlic powder or 1 clove garlic, crushed
1/4 tsp. rosemary
1/4 tsp. oregano
1/4 tsp. dried dill weed
1/2 tsp. salt
1/4 tsp. paprika
2 tbsp. honey or brown sugar
1 tbsp. parsley
1 tsp. season all

Combine ingredients. Pour over steak. Marinate overnight. Turn meat several times.

There are cheaper ways to hunt deer though, but if you want to hunt them with vehicles you will loose some meat due to the impact hemmoraging, LOL.

Number 1 is already in the freezer...

Gotta love a charcoal guy, thats the only way to eat meat (my favorite vegetable). PCB is the Pure Country Band, he must have been "hunting" with the tour bus...

Thanks, Gomp. Deer season's not far off, and I do intend to grill (or smoke) venison for the first time this year. Charcoal is the only way to go, and with a chimney (no lighter fluid) at that.

Hurlbert is a disgrace to the legal profession, as Frank's post above makes clear. What's astonishing here (among other things) is that the "poor and downtrodden" includes doctors.

Interestingly, and while on the subject of animals, there's a terrific straight exacta in this very thread:

Try lump charcoal, and Jack Daniels whiskey barrel oak wood chips or Stubbs Texas Roadhouse wood chips (blend of Oak, Hickory, and Apple) they both make a fine smoke.

Tis the season for smoke in the air... The chimney is the only way to go, down with hydrocarbons. Good luck with the hunt.

Its realy sad, everywhAre you look. The American People are getting the shaft over something. From mornning till night, goverment is in our face.

The PCB Grill was just a small Smokey-Joe. 14''. When ever we did a 2 nighter, or the big concrts in the field for 500-to-100 thousand people, we pulled out the grill and in no time we were eatting. It dident take up much space and was used a lot.

I called it my Baggage-Bay Kitchennet. Fridg., Freezer, hot-cold water. Roll out gas grill, & PCB Grill, for the Meat. The family "Band" that prayes-eats togeather, says togeather. By eatting out side, the bus dident look like we had a all night party inside.

Crap, I did have a fun time making a living once apon a time, dident I . & yes, we dident plan on eatting deer on the grill, but it happened. So we found a butcher shop, stoped back in a few weeks and got 10-15# of meat and gave the rest to the butcher to use or give away.

Follow Gomps ......Here is a good venison marinade Cheyenne, I dought anyone could out do fixin food the way he dose. Martha Stewarat is always calling him for advice. Tex !
