Glenn Greenwald: "The Rule Of Law Is Dead In America"

With liberty and justice for some.

Greenwald speaks at Yale Law School, March 11.

'We need to put the fear into these people.  In a healthy society, politicians should always fear for their job, and sometimes fear for their physical safety.  In a tyrannical society, people fear the government.  We have a tyrannical society.'

Start watching at the 28-minute mark and listen for about 5 minutes.

Update: More on this clip from Titus who first alerted us to this speech.

Eric Holder confirmed to Chuck Grassley last week what is now official U.S. legal policy: the super rich are officially above the law.  Glenn Greenwald makes that very point in this speech.  He freely concedes that the U.S. has NEVER--in practice--satisfied the ideal sought by the rule of law.  What it had always done until recently, he contends, is to hold up the rule of law as the official chalice of the realm.  That is no longer the case, Greenwald says, which he explains using two very interesting personal experiences beginning in 2005.  In the first few minutes, he lays a little groundwork that includes the proposition that any system of governance faces a binary choice between the rule of law and the rule of man.

The pertinent segment is between 11:40 and 21:15 of the above video.

I've noticed the phenomenon Greenwald speaks of -- not just among the political and media class whom we read about and observe from afar, but among my own students and especially my younger colleagues (I'm in my mid 30s). Getting along, getting ahead, pleasing those in power -- or, more pertinently, not DIS-pleasing those in power -- those are the guideposts by which many people live out their professional and personal lives (I nearly typed "lies"). If it might screw up your career, you DON'T do it. That is an iron law. By the same token, no matter how wrong, dishonest or sleazy, you damn well do it, if you want to be successful, because everyone else, or someone else, is going to do it.

Speaking of rotting fish, we're all familiar with Bernanke, Geithner, et al. -- abject screwups (in my view) who should have long ago fallen on their swords. Well, it's clear to me that the rot gone from the select few to corrupt the entire culture.

And I'm not just saying all this as part of some kind of old man's Jeremiad. There are clear political consequences for what's going on. Try to imagine today's 20-somethings taking a cue from the 60s generation and mobilizing to stop a war, for example. It's fucking ridiculous. It just wouldn't happen. They're too busy padding their resumes, looking for internships and trying to game the system in their favor -- and I'm talking about the good kids, here. Sure, part of that is the nature of the labor market in the present moment, but a big part of it is culture and outlook. It just wouldn't occur to them that they could or should drop everything and stick it to the Man. Sure, there's Occupy, but those kids (and I know they're not all kids) are totally marginal to the larger youth culture. Along with mumps and measles, they've been systematically inoculated against outrage.

Welcome to the American Just-us system...

Dr. P,

I think much to do with the youth of today has to do with doading parents, and tv games keeping them firmly planted on the couch. I know parents who actually pay their child's child support for them while they live in the basement sleeping till noon and playing video games till they get hungry and then look for the twenty their parents left for them on the table to order a pizza...

I guess it takes to much time away from the game to actually cook something while they are being disfunctionally lazy.

Cui bono? Destruction via trained and disciplined agents hell bent on destruction of the U.S. Constitutional government and other economic competition. Which government, once top dog for centuries but now hopelessly in debt 10X GDP with only the American military to burn and pillage just like the bad old days?

I think we were targeted by the best propaganda machine the world has ever seen. And you know, the funny thing is, we funded it. So until our people learn to look up, we'll keep letting them cart us off, to prison, to war, out of our homes and into the lawless world.
I don't really know who all to blame. I just know we were targeted.
