This must be a recently developed white-collar defense tactic -- say that your client isn't guilty for the crimes of the industry or his peers. It sounds like Weingarten didn't use that tactic in this trial, but came up with it for the Rose interview. The same sort of defense was offered -- during the trial -- by lawyers for a banker from Citi recently. Khuzami was chief counsel of Deutsche Bank, I believe, before coming to the SEC. The link above explains how that experience has helped him...um, do his job.

Ummm, wow. Weingarten’s explanation of how Bernie Ebbers was convicted should serve as an inspiration to the entire DOJ. Holder has always contended that he’d love to prosecute fraud by Wall Street executives, but that the high burden of proof frightens his testicles back inside his body, causing his sad little tent to fold.

Enter Reid “Tony Robbins” Weingarten, explaining how Ebbers was convicted beyond a reasonable doubt:

“Bernie Ebbers the man, I don’t believe was prosecuted, tried, convicted, and sentenced. I think some distorted caricature of the corrupt CEO emerged, and that was tried, convicted and sentenced.”

“I think generally speaking it went well for us in court. I think we won the skirmishes, we won the battles in the courtroom. But in the back of my mind, I knew the quote, zeitgeist, unquote, was out there against me. And it seems like the bricks in the walls were telling me that this was like the French Revolution: somebody’s head had to be chopped off because of all the people who had lost so much money, and Bernie Ebbers was public enemy number one.”

You see that, Eric? All you need is a caricature and a jury with bloodlust to do your job rather than making absurd excuses.
