FLASHBACK - 20% of Obamacare waivers are gourmet restaurants, nightclubs, hotels in Nancy Pelosi’s district

Of the 204 new Obamacare waivers President Barack Obama’s administration approved in April, 38 are for fancy eateries, hip nightclubs and decadent hotels in House Minority Leader Nancy Pelosi’s Northern California district.

That’s in addition to the 27 new waivers for health care or drug companies and the 31 new union waivers Obama’s Department of Health and Human Services approved.

Pelosi’s district secured almost 20 percent of the latest issuance of waivers nationwide, and the companies that won them didn’t have much in common with companies throughout the rest of the country that have received Obamacare waivers.

Other common waiver recipients were labor union chapters, large corporations, financial firms and local governments. But Pelosi’s district’s waivers are the first major examples of luxurious, gourmet restaurants and hotels getting a year-long pass from Obamacare.

For instance, Boboquivari’s restaurant in Pelosi’s district in San Francisco got a waiver from Obamacare. Boboquivari’s advertises $59 porterhouse steaks, $39 filet mignons and $35 crab dinners.

john, you're exactly right. This is something we've known for some time, but this latest ruling is just so blatantly stupid and in-your-face that it is indeed making people angry. Personally, I'm not surprised by any of it -- but something about Obamacare just makes you angry.

The USSC upheld Obamacare by, basically, twisting the Constitution into a pretzel, crapping on it, whizzing on that and then eating it.

Finding first that the Commerce Clause bars the government from compelling one to enter into commerce, the analysis then turned to whether there was any way to save the constitutionality of the act.

The justices found one.

They re-interpreted the penalty clause as a tax.

And of course, Congress can levy taxes.

That's the path taken by this tortured process -- a path that could only be dreamed up if someone had already determined the outcome they sought instead of being an independent jurist.

The real surprise, however, is that Chief Justice Roberts, believed to be a strict constructionist on the court, managed to not only agree with this piece of tortured logic he found and constructed it as the opinion is his!

So much for judicial restraint and strict construction!

You really ought to read the dissent that starts on page 127 of the opinion. Justice Scalia, Thomas, Kennedy and Alito eviscertate the majority, saying in part:

Here, however, Congress has impressed into servicethird parties, healthy individuals who could be but are not customers of the relevant industry, to offset the undesirable consequences of the regulation. Congress’ desire to force these individuals to purchase insurance is motivatedby the fact that they are further removed from the marketthan unhealthy individuals with pre-existing conditions, because they are less likely to need extensive care in the near future. If Congress can reach out and command even those furthest removed from an interstate market to participate in the market, then the Commerce Clause becomes a font of unlimited power, or in Hamilton’s words, "the hideous monster whose devouring jaws . . . spare neither sex nor age, nor high nor low, nor sacred nor profane." The Federalist No. 33, p. 202 (C. Rossiter ed. 1961).

What little was left of The Constitution died today, June 28th, 2012.

My favorite part of the Constitution is where the founders wrote that Congress could use punitive taxes to support things they otherwise don't have the authority to do.

This is hilarious, anyone seen Romney's signs "repeal and replace"? I prefer my own insurance that I buy, it is tailored to me. How about just repeal. This is all about creating another pool of money to exploit on both sides of the arguement, no one in gevernment or the private sector anymore remembers a little term called fiduciary responsibility...

 I think Rule Of Law and the Republic are done for. The Elites have consolidated their power, destroyed the Constitution and are directing a sold out government to legalize fraud, extortion, civil rights violations and damn near any crime you can think of when committed by government or special interest corporate entities. Personal freedom and the rights granted by the U.S.Constitution are ignored by those sworn to defend and support it. Denied by government, law enforcement, and the highest court in the land the Constitution is as G.W. Bush Said, nothing but a damn piece of paper.  
    I've read the Rise And Fall Of The Third Reich again and am totally amazed how close today the U.S. is paralleling the rise of National Socialism in Germany in the late 20's and early 30's. In twenty first century America True Justice has become an obsolete term.  
No one should be above the law but, the one percent have figured out a way around that.  Ignore the law, buy everyone involved with legislation, regulation, enforcement, and prosecution and ignore the law. They are beyond the law and they rule the world.
